1. Agreement to Terms

By accessing or using WhaleMaps (whalemaps.io), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our service.

These terms constitute a legally binding agreement between you and WhaleMaps. Your continued use of the service after any changes to these terms constitutes acceptance of those changes.

2. Description of Service

WhaleMaps is a cryptocurrency market analytics platform that provides:

• Real-time order book heatmaps and visualizations
• Options analytics including Gamma Exposure (GEX) data
• Whale wall tracking and large order detection
• Liquidation level mapping
• Coverage across 70+ tokens and 5 exchanges (Binance, Coinbase, Bybit, OKX, Hyperliquid)

3. Accounts & Registration

To use WhaleMaps, you must create an account. By registering, you represent that:

• You are at least 18 years of age
• All information you provide is accurate, current, and complete
• You will maintain and update your information as needed
• You will maintain only one account per person
• You will not share your account credentials with others

You are responsible for safeguarding your account and for all activity that occurs under it. Notify us immediately via Discord if you suspect unauthorized access.

4. Subscriptions & Billing

WhaleMaps offers the following paid subscription plans:

• Basic: $25/month or $228/year
• Pro: $35/month or $348/year

Free Trial. New subscribers may be eligible for a 10-day free trial. At the end of the trial period, your subscription will automatically convert to a paid plan unless you cancel before the trial ends. You will not be charged during the trial period.

Billing. All payments are processed securely through Stripe. WhaleMaps does not store your credit card or payment details. By subscribing, you authorize Stripe to charge your chosen payment method on a recurring basis.

Auto-Renewal. Subscriptions automatically renew at the end of each billing cycle (monthly or annually) unless cancelled.

Cancellation. You may cancel your subscription at any time. Upon cancellation, you will retain access to paid features until the end of your current billing period. No refunds are provided for partial billing periods.

Price Changes. We reserve the right to adjust pricing. Any changes will take effect at the start of your next billing cycle, and we will notify you in advance.

5. Acceptable Use

You agree not to:

• Scrape, crawl, or use automated tools to extract data from WhaleMaps
• Redistribute, resell, or publicly share WhaleMaps data, screenshots, or visualizations for commercial purposes
• Reverse engineer, decompile, or attempt to extract the source code of the platform
• Circumvent or interfere with any security features or access controls
• Use the service to engage in any activity that violates applicable law
• Overload or disrupt the service infrastructure
• Create multiple accounts to abuse trial periods or promotions

6. Intellectual Property

The WhaleMaps platform — including its design, interface, visualizations, algorithms, branding, and all related content — is owned by WhaleMaps and protected by applicable intellectual property laws.

Market data displayed on WhaleMaps is sourced from publicly available exchange APIs. WhaleMaps does not claim ownership of raw market data. However, the specific way we aggregate, process, visualize, and present this data is proprietary.

You may not copy, modify, distribute, or create derivative works based on our platform without prior written permission.

7. Disclaimers

No Guarantees on Data Accuracy. While we strive to provide accurate and timely data, WhaleMaps makes no warranties or guarantees regarding the accuracy, completeness, reliability, or timeliness of any data displayed on the platform. Data is sourced from third-party exchange APIs and may contain errors, delays, or discrepancies.

Use at Your Own Risk. The service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

No Uptime Guarantee. We do not guarantee uninterrupted access to the service. Exchanges may change their APIs, experience downtime, or restrict data access at any time, which may affect our service.

8. Limitation of Liability

To the maximum extent permitted by applicable law, WhaleMaps and its operators, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or data
• Trading losses or missed opportunities
• Damages arising from reliance on data displayed on the platform
• Service interruptions or data inaccuracies

In no event shall our total liability exceed the amount you paid to WhaleMaps in the twelve (12) months preceding the claim.

9. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

Upon termination, your right to use the service will immediately cease. Provisions of these terms that by their nature should survive termination shall survive, including ownership, disclaimers, and limitations of liability.

10. Changes to Terms

We may update these Terms of Service from time to time. When we do, we will revise the "Last updated" date at the top of this page. Your continued use of WhaleMaps after any changes constitutes your acceptance of the new terms.

For significant changes, we will make reasonable efforts to notify users through the platform or via email.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising from these terms or your use of the service shall be resolved in accordance with applicable law.
